FACTS: Evaristo
Vaquilar was found guilty of killing his wife and daughter, as well as injuring
other persons with a bolo. Witnesses testified that he appeared to be insane
prior to the commission of the crime. Alleged evidence of defendant’s insanity
was shown when his eyes were very big and red and he looked like crazy.
ISSUE: W/N Vaquilar is
suffering from insanity during the commission of the crime
HELD: Evidence was
insufficient. Being crazy is not equal to being insane.
